FREEDOM OF INFORMATION ACT

Enacted in 1966, and taking effect on July 5, 1967, the Freedom of Information Act (FOIA) was created to provide the public a means to request and obtain federal government records, while still allowing sensitive information to be protected from public release. The government must make available to any requester its records unless specifically exempted or excluded in accordance with Title 5 U.S.C. 552, Freedom of Information Act.

DIA FOIA ANNOUNCEMENTS

On June 20, 2021, the Office of the Director of National Intelligence (ODNI) received full responsibility for the National Intelligence University. Due to this transfer of responsibility from DIA to ODNI, DIA no longer owns thesis records. The ODNI instructed the DIA to inform all requesters with thesis requests to submit their requests directly to ODNI for action. Therefore, the DIA is closing all open requests and not accepting any new requests for thesis or dissertations; including but not limited to the Joint Military Intelligence College or National Intelligence University. If you are interested in obtaining thesis records, please submit a FOIA request to the Office of the Director of National Intelligence either via email ([email protected]) or at the address below:

Effective 1 February 2023, the DIA FOIA Service Center will post monthly updates containing the case number and review status of all open cases. Requesters may review this spreadsheet, at their leisure, to determine the status of their FOIA request.

The review status for FOIA requests are as follows:

  1. Initial Processing
  2. Records Search/Review
  3. Record Processing
  4. Quality Control Review
  5. Additional Action Required
  6. Delivery to the Requester

 

Please note that each request is unique and may not need to go through every phase. Additionally, there are other factors that may impact processing. For example, processing time will increase if multiple coordination efforts are required.

On December 14, 2005, President George W. Bush signed Executive Order 13392, Improving Agency Disclosure of Information. In accordance with the Executive Order, agencies were required to establish FOIA Requester Service Centers and identify FOIA Chief Public Liaisons.

SUBMITTING A FOIA REQUEST

All FOIA requests must be in writing (letter/email) and the records requested must be reasonably described. The description should contain sufficient file-related information (type of document, title, subject area, date of creation, originator, etc.); or enough event-related information (date and circumstances surrounding the event the record covers) to permit an organized, non-random search.

SUBMITTING A PRIVACY ACT REQUEST

To submit a request for personal records (i.e. personnel, investigative matters, etc.) a Privacy Act request is required. Please send a written request via mail/email, using the below form. Describe the specific records you are requesting in enough detail so that they can be located with a reasonable amount of effort.
* Please note, that in the case where you are authorizing a party, other than yourself, to submit a request on your behalf, a signed Third-Party Release document is also required .

SUBMITTING A PRIVACY ACT 3RD PARTY RELEASE REQUEST

Use in the case where you are authorizing a party, other than yourself, to receive information about you regarding your Privacy Act request. Examples might be: your lawyer or another party you choose to designate to act on your behalf in receiving the information.

If you would like to submit a Privacy Act 3rd Party Release Request, please send a written request by mail, fax or email. Please fill out the below form and describe the records you want as specifically as possible and state the amount of fees that you are willing to pay. A completed form is required to conduct a search.

FOIA ELECTRONIC READING ROOM

In 1996, the FOIA was amended, requiring agencies to establish Electronic Reading Rooms. The Electronic Reading Room contains documents specifically identified for inclusion by the FOIA, as well as documents for which we have received multiple FOIA requests.
